Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

The aim of the present study was to provide support for the validation of the Teammate Burnout Questionnaire. Athletes from a variety of team sports completed the TBQ and the Athlete Burnout Questionnaire. Confirmatory factor analysis revealed acceptable fit indexes for the three-dimensional models of the TBQ and the ABQ. Multi-trait multi-method analysis revealed that the TBQ and ABQ showed acceptable convergent and discriminant validity. The preliminary validation of the TBQ indicates the utility of the scale to reflect athletes’ perceptions (...) of their teammates’ burnout and offers researchers the opportunity to quantitatively assess an important aspect of the social environment in the development of athlete burnout. The eight pieces constituting this Meeting Report are summaries of presentations made during a panel session at the 2011 Association for Practical and Professional Ethics (APPE) annual meeting held between March 3rd and 6th in Cincinnati. Lisa Newton organized the session and served as chair. The panel of eight consisted both of pioneers in the field and more recent arrivals. An archive is a repository - that is, a place or space in which materials of historic interest or social significance are stored and ordered. A national archive is the storing and ordering place of the collective memory of that nation or people(s). This article provides a brief his torical/theoretical introduction to the politics of the archive in late capi talist societies and discusses this politics of memory via the performance of ordinary daily activities of librarians and archivists. Some relevant (...) political/discursive questions include: who controls, establishes and maintains the archive, and how do they do so? Which materials are preserved in the archive and which are excluded? As the documents and artifacts selected for the archive are ordered and classi fied, how do the schemas and structures applied include, exclude, fore ground or marginalize those materials? Finally, to what extent do the logical hierarchies for classification and arrangement reflect social or political hierarchies? The authors give real-life examples of choices made as archivists struggle to balance ideological goals made contradictory by practical constraints. For example, is it more appro priate to acquire as many materials as possible but be unable to describe, preserve and present them adequately, or is it preferable to describe, preserve and make fully available a more limited range of records and documents? Because of such practical concerns in modern technicist cultures, the explicitly political who often is reduced to the technically instrumental how - that is, political-moral questions are displaced to nonmoral and nonpolitical technical discourse, thereby establishing a 'meta-politics' that is understood only by the initiated. Conversely, archival activities such as acquisition, classification and preservation are 'technical' activi ties that may become explicitly 'political'. The article concludes that technical activities always are political, at least latently or potentially, even when they are not contested and made explicitly political. (shrink)

Effective Altruism is a movement and a philosophy that has reinvigorated the debate about the nature of beneficence. At base, it is the consistent application of microeconomic principles to beneficent action. The movement has exposed that many forms of giving do little good (or do active harm), but others do tremendous good. Questioning Beneficence uses Effective Altruism as a launchpad to ask hard questions about beneficence more generally. Must we be Effective Altruists, or is Effective Altruism and the ideas driving (...) the movement a mistake? How much should we give and-if anything-how should we give it? What are the respective roles of different kinds of institutions? Is charity anti-democratic and do billionaire philanthropists have too much power? Is Effective Altruism just utilitarianism in disguise? Questioning Beneficence is written by four philosophers, each with distinct points of view. It introduces a new standard for debating ideas in philosophy as each author poses and answers three questions and each of his three co-authors responds to those questions in turn. Finally, the first author replies to his co-authors' responses. Throughout the book, there is a spirit of curiosity, intellectual risk taking, and truth-seeking, rather than point-scoring and one-upsmanship. Initially introduced to the philosophical world as elusive, we-know-notwhats—substrata underlying the properties had or exemplified by things, but themselves bereft of properties—bare particulars have been dismissed as undetectable, unnecessary, and even incoherent. Hardly a warm welcome. It appears, however, that times are changing. In a recent series of articles, for example, J. P. Moreland has argued that “bare particulars are crucial entities in any adequate overall theory of individuation”;’ that is, concrete particulars cannot be individuated without them. In the same (...) vein, Oaklander and Rothstein,2 drawing upon elements of Moreland’s new theory, have defended bare particulars against Loux’s grounding objection’—that if the theory is correct, bare particulars are qualitatively indiscernible; in which case we either have no basis for saying that they arc numerically diverse, or we must introduce lower-level substrata to ground that diversity, thereby raising the spectre of an infinite regress of individuators. In a recent article in this journal, J. P. Moreland extends his theory of individuation to include universals. In this note, I show how Moreland’s novel proposal leads to the unwanted conclusion that every concrete particular exists of necessity and has but a single essential property.

In Adelaster (2016), A. G. Conte proposes a distinction between de dicto and de re attributions of truth and falsity, which he illustrates mostly with documents of legal standing, but also with an artificial object (a false tooth). The present aim is to propose an analogous distinction between monadic (one-place) and polyadic uses of “true” and “false”, and to sketch some features of its logical functioning with closer attention to the monadic pole than is usual. Valid consent requires the potential research participant understands the information provided. We examined current practice in 50 proposed Clinical Trials of Investigational Medicinal Products to determine how this understanding is checked. The majority of the proposals ( n = 44) indicated confirmation of understanding would take place during an interactive conversation between the researcher and potential participant, containing questions to assess and establish understanding. Yet up until now, research design and review have not focussed upon this, concentrating more on written (...) material. We propose ways this interactive conversation can be documented, and the process of checking understanding improved. (shrink)

This paper examines the strategies for the legitimisation of power in courtroom encounters. It focuses on how discourse becomes the instrument for power and control during the judicial process of witness examination in a Nigerian courtroom context. Legitimisation, as used in this study, therefore, provides more insight into how language use within an institutionalised setting becomes the locus of social interactions designed to achieve specific social goals. Critical Discourse Analysis (CDA) was adopted as the theoretical framework to undergird the description (...) and discussion of the data. The data for this study was drawn from the proceedings of two regional Election Petition Tribunals in South-western and North-eastern Nigeria in 2007 and 2011 respectively. The legal contexts provide the adversarial space for the use of discourse as power and control. The findings reveal that various legitimisation strategies such as confrontational move, circumlocution and pleading forgetfulness along with such traditional strategies as authorisation, moralisation and rationalisation are deployed by the discourse participants to legitimise and delegitimise power in this institutional setting. The paper shows that language is crucial in the judicial process and should be carefully handled so that litigants can have sufficient confidence in the process and be reassured of effective resolution to their legal matters. In this article, I critically assess Peter van Inwagen’s rejection of C. S. Lewis’s argument against Naturalism. Van Inwagen argues that Lewis (1960) errs on two fronts. First, he falsely assumes that Naturalism implies Spinozism: that the only way the world could be is the way it is. Second, the central premise of Lewis’s argument is asserted without proof. I argue that van Inwagen is mistaken on both counts.

In April, 2007, 15 Royal Navy sailors and marines were taken prisoner and held hostage for nearly two weeks by Iran’s Revolutionary Guard. Their crime? Allegedly crossing over into Iranian waters. Within 48 hours a British sailor was plastered all over Iranian TV publicly confessing that the Britons were entirely at fault in the matter. Another sailor wrote a letter—no doubt under some duress— calling for the UK to withdraw all of its troops from Iraq. Then to cap things off, (...) the British soldiers were paraded in front of the Iranian President, where they gave him a big “thumbs up” before being allowed to go home. If you were one of the captives, what would you have done? Would you have cooperated with your captors? Or would you have resisted them, possibly putting your own life at risk? Not surprisingly, the British people recoiled in shame. As one commentator put it, “The honorable thing would have been to renounce their coerced behavior, denounce the Iranians’ use of them for propaganda, and acknowledge that anything they endured was nothing.. Thought experiments are characteristically armchair operations. The key thought experiment in Rawls’s A Theory of Justice, the “veil of ignorance”, calls on us to imagine having complete knowledge of the social sciences at the same time as lacking all knowledge about the positions we occupy in the society of which we are members. It is harder to imagine having – and using – knowledge we do not have than it is to imagine not having knowledge we do have. Even when (...) we think we can imagine not having knowledge of what is to our advantage, we may nevertheless be partial about our priorities in drawing consequences from the thought experiment. Background: Despite procedural innovations and increasing numbers of uterus transplant attempts worldwide, the perspectives of uterus transplant (UTx) trial participants are lacking. Methods: We conducted a mixed-methods study with women with absolute uterine factor infertility (AUFI). Participants included women who had previously contacted the Cleveland Clinic regarding the Uterine Transplant Trial and met the initial eligibility criteria for participation. In-depth interviews were conducted in conjunction with FertiQoL, a validated and widely used tool to measure the impact of infertility on the (...) quality of life of infertility patients. Results: All (n = 19) rated their overall health as good; some experienced grief and social isolation. AUFI is a life-framing experience that influences acceptance by family, partners, peers, and one’s self. UTx is a means to gain control of reproductive autonomy. UTx allows family-building and the ability to play an active role in prenatal health and well-being. Establishing and maintaining a supportive relationship is a key issue of AUFI and when considering UTx. Risks of UTx are perceived relative to risks to self/child/family posed by adoption/surrogacy. Participants had no overall preference regarding living or deceased donor. Conclusions: The ways in which women with AUFI conceptualize this condition in their lives and choices around UTx and participating in a study of the procedure are multifaceted and textured. These perspectives are critical to understanding its ethical, legal, and social implications. (shrink)

Although information-processing theories cannot provide a full explanatory account of P-consciousness, there is less conflation and confusion in cognitive psychology than Block suspects. Some of the reasoning that Block criticises can be interpreted plausibly in the light of a folk psychological view of the relation between P-consciousness and A-consciousness.

Clouser and Gert’s 'A Critique of Principlism’ (1990) has ignited debate over the adequacy of substituting principlism for moral theory as a means for dealing with biomedical dilemmas. Clouser and Gert argue that this sort of substitution is not adequate to the task. I examine their argument in light of recent defences of principlism on this score, those of B. Andrew Lustig (1992), David Degrazia (1992), and Beauchamp and Childress (1994). I argue that both sides in the debate have assumed (...) differing conceptions of a moral theory that virtually guarantee their respective conclusions. These differing conceptions are motivated by antecedent epistemological commitments. The present debate over principlism is therefore inconclusive. Future discussion should focus on the underlying epistemological issues. (shrink)

Crespi & Badcock (C&B) provide a novel hypothesis outlining a role for imprinted genes in mediating brain functions underlying social behaviours. The basic premise is that maternally expressed genes are predicted to promote hypermentalistic behaviours, and paternally expressed genes hypomentalistic behaviours. The authors provide a detailed overview of data supporting their ideas, but as we discuss, caution should be applied in interpreting these data.

In his Moderate Realism and Its Logic (Yale, 1996), Donald Mertz argues that the traditional ontology of nonpredicable substances and predicable universals is beset by “intractable problems,” “harbors an insidious error,” and constitutes a “stumbling block” for the ontologist. By contrast, a onecategory ontology consisting of relation instances (and combinations thereof) is sustainable, and indeed the only way of avoiding commitment to bare particulars. The success of the project turns on Mertz’s claim that every relation instance has a linking aspect, (...) so that (in a sense) even Socrates is a predicate. I argue that, ironically, it is this very feature of a relation instance that undermines Mertz’s entire theory of predication, effectively preventing any connections from being formed between the instances that allegedly compose an ordinary individual such as Socrates. In a recent article Ian Hacking argues that there can be cases where no probabilities may correctly be ascribed to individual members of a population, while probabilities are correctly ascribable to the population as a whole. In this paper a simple artificial coin-flipping model for such probabilities, not 'grounded from below' is constructed. The inferences licensed by this model and a consequence of the model for the theory of statistical tests is explored.

Descartes is often regarded as the founder of modern philosophy, and is credited with placing at centre stage the question of what we know and how we know it.
